Request: It is requested that the DeKalb County Board of Education (“the Board”) approve the revision of the agreement between the DeKalb County School District and DeKalb County Government, from $44,550 to $70,470 for SY25-26 After-School Snacks Program.
Why: DeKalb County Government has requested the revision to the agreement that was approved during the Board’s August 11, 2025 meeting. The program daily snack requirement has changed from approximately 275 snacks daily to approximately 435 snacks daily.

Financial impact: There is no impact to the DeKalb County School District general budget. School Nutrition Services will gain the anticipated revenue of $70,470, minus expenditures, of $58,725 (food, labor and supplies).

Agreement to Furnish Food Service for the DeKalb Parks and Recreation After School Snacks
This agreement is made and entered into between DeKalb County School Nutrition Services and DeKalb Parks and
Recreation. WHEREAS the DeKalb County School Nutrition Services agrees to provide daily unitized after school
snacks to nine DeKalb Parks and Recreation Programs.
DeKalb Parks and Recreation is solely responsible for serving after school snacks provided by DeKalb County School
Nutrition Services and shall maintain HACCP Procedures. DeKalb County School Nutrition Services will provide
after school snacks effective August 4, 2025 through May 28, 2026. School Nutrition Services will not provide meals
if schools are closed for inclement weather.

Snacks
Labor: Providing snacks will generate potential labor hours for the DCSD schools preparing the snacks.
Delivery Cost: DCSD will provide coolers to assist with maintaining HACCP temperatures per Georgia Food
Service Code: 290-5-14-.08-(d). Parks and Recreation Site Directors will pick up DCSD snacks and directly
transport to Parks and Recreation Sites. After School Snacks will be picked up by the Parks and Recreation Site
Director between 12:00 noon – 1:00 pm.
Estimated Cost of Contract (Food and Labor): = $70,470.00
After School Snack Menus
It is further agreed that the DeKalb County School District, pursuant to the provisions of the National School Lunch,
Breakfast, and Snack Program regulations, 7 CFR Part 225**, attached copy of which is part of this agreement, will
assure that after school snacks meet the minimum after school snacks pattern requirements as to components and
portion sizes, as found in the federal regulations. Milk will be offered 2 times per week and juice 3 times per week
(attached menu). All potentially hazardous food that has been prepared, stored, and transported must be stored at a
temperature of 41 degrees or below.
Record Keeping and Meal Accountability
DeKalb County School Nutrition Services will maintain full and accurate records for after school snacks, including
menu records containing the amount of food prepared and daily number of after school snacks delivered. It is further
understood that DeKalb County School Nutrition Services is ultimately responsible for documenting and assuring
nutritional adequacy according to 7 CFR 225.
An After-School meal preparation document will be provided to the After-School Site Director during the scheduled pick-
up. The number of snacks provided will be recorded on the document by the School Nutrition Services Manager. The
School Nutrition Services Manager is required to maintain a copy and send a copy to the School Nutrition Services
Central Office Data Specialist.
DeKalb County School District agrees also to retain records required under the preceding clause for a period of three (3)
years from the date of receipt of final payment under this agreement (or longer, if an audit is in progress); and upon
request, to make all accounts and records pertaining to the Program available to DeKalb Parks and Recreation for audit
or administrative review at a reasonable time and place.
Reconciliation. The DeKalb County School Nutrition Services shall provide a tentative list of snacks served to Parks
& Recreation biweekly. The list will be provided to aid in meal reconciliation.
Pavement. The DeKalb County School Nutrition Services shall send an itemized bill of delivered meals to: DeKalb
Parks and Recreation, 1950 W. Exchange, Suite 400, Tucker, GA 30084. Within thirty (30) days of receipt of the
itemized bill, the DeKalb Parks and Recreation shall remit payment for delivered after school snacks to the DeKalb
County School Nutrition Services.
Entire Agreement. This agreement is established on a temporary basis and constitutes the entire agreement between
the Parties with respect to the matters set forth herein and supersedes all prior, contemporaneous, written or oral
negotiations, agreements, or understandings between the Parties regarding such matters.
Modification. This agreement may not be changed, modified, amended or altered except in a written agreement signed by
the Parties.
Governing Law. This agreement shall be governed by and construed and enforced in accordance with the laws of the
State of Georgia. All actions or proceedings arising out of or related to this Agreement shall be brought in the state
or federal courts located in or for DeKalb County, Georgia. Each Party hereby unconditionally and irrevocably consents
to the jurisdiction of such courts and waives its rights to bring any action or proceedings against the other Party except in
such courts.
Effective Period of Agreement: This Agreement shall be effective as of August 5, 2024. As required by O.C.G.A. § 20-2-506,
this Agreement shall terminate absolutely and without further obligation on the part of the School on December 31, 2025 but
shall automatically renew on January 1, 2026 and terminate on May 28, 2026. Future considerations will be reviewed and
approved on an annual basis by the School District.
