Request: It is requested that the DeKalb County Board of Education (“the Board) approve DeKalb County School District (“DCSD”) use of the OMNIA Partners Cooperative Agreement - Contract #R24-16 - Job Order Contracting (JOC) Services to provide services for repairs, alterations, and minor construction projects on an as-needed basis for an amount not to exceed $8,000,000 to the following vendors:


ABM Industries Inc.,
Brown & Root Industrial Services LLC
F.H. Paschen, S.N. Nielsen & Associates LLC
Why: Approval of this request will establish a pool of qualified general contractors to support the Facilities and Maintenance Department in performing repairs, renovations, alterations, and small construction projects district-wide.

Under this contract, each contractor will furnish all management, labor, materials, equipment, and incidental design or engineering support necessary to perform assigned projects in accordance with approved task orders and pricing established through OMNIA’s competitively solicited Job Order Contracting (JOC) system.

Partners Cooperative Agreement - Contract #R24-16 - Job Order Contracting (JOC) Services to provide services for repairs, alterations, and minor construction projects on an as-needed basis district-wide by the following vendors:

ABM Industries Inc.,
Brown & Root Industrial Services LLC
F.H. Paschen, S.N. Nielsen & Associates LLC

The use of the OMNIA Partners Cooperative Contract #R2416 will allow the Facilities and Maintenance Department to respond efficiently to facility needs while maintaining fiscal responsibility through pre-established, competitively solicited rates. This contract enables the rapid deployment of time-sensitive repairs and facility upgrades, while ensuring compliance with all applicable procurement laws and DCSD policy.

OMNIA Partners Cooperative Agreement - Contract #R24-16 is for an initial term of two (2) years with three (3) optional one (1) year renewals, with the renewal offer at the sole discretion of OMNIA.

This recommendation is based on the review and evaluation of the proposals by the Region 4 ESC Evaluation team. OMNIA issued a public solicitation for Contract #R24-16 - Job Order Contracting (JOC) Services from which the above vendors were awarded a contract.
Financial impact: The total contract amount for RFCSP Contract #R24-16 - Job Order Contracting (JOC) Services for repairs, alterations, and minor construction projects is a not to exceed amount of $8,000,000.

The financial impact of the contract amount will be allocated from the General Fund, General Operations and Capital Improvement Funds, Facilities and Maintenance: Cost Code 100.2600.543013.00011.7520.9990.8013.040.0000.

Procurement Method: The governing body of Region 4 ESC and/or its designated representative have determined
that the Competitive Sealed Proposals method of procurement will provide the best value for Region 4 ESC for
this project. This procurement shall conform to Section 2269 of the Texas Government Code. Region 4 ESC
anticipates selecting one (1) or more successful Contractors that will offer the “best value” to Region 4 ESC based
on the published evaluation criteria. In this procurement method, pricing bids were sealed and the proposal with
the lowest coefficient for Texas Statewide Normal Working Hours (price) received the maximum points; every
additional proposal received a percentage of points based on a comparison with the lowest coefficient price
proposal (see page 17 of the RFCSP). The remaining evaluation factors (as identified in the RFCSP on page 17) were
technically evaluated accordingly by evaluation committee members. Evaluation and ranking information can be
obtained on the OMNIA Partners website and/or by request.

The Region 4 Education Service Center (ESC) Department of Procurement issued RFCSP 24-16 on October 7,
2024, to establish a national cooperative contract for Job Order Contracting Services. As indicated in the RFCSP,
Awarded Offerors may perform services nationwide where indicated in their proposals. Offerors were asked to
provide a bid guarantee during the solicitation process.

The solicitation included cooperative purchasing language in Section I. Scope of Work:

          NATIONAL CONTRACT

          Region 4 ESC, as the Principal Procurement Agency, defined in APPENDIX E, has partnered with OMNIA
          Partners, Public Sector, Inc., a Delaware corporation (“OMNIA Partners”) to make the resultant contract
          (also known as the “Master Agreement” in materials distributed by OMNIA Partners) from this solicitation
          available to other public agencies nationally, including state and local governmental entities, public and
          private primary, secondary and higher education entities, non-profit entities, and agencies for the public
          benefit (“Public Agencies”), through OMNIA Partners’ cooperative purchasing program. Region 4 ESC is
          acting as the contracting agency for any other Public Agency that elects to utilize the resulting Master
          Agreement. Use of the Master Agreement by any Public Agency is preceded by their registration with

          OMNIA Partners (a “Participating Public Agency”) and by using the Master Agreement, any such
          Participating Public Agency agrees that it is registered with OMNIA Partners, whether pursuant to the
          terms of a Master Intergovernmental Cooperative Purchasing Agreement, a form of which is attached
          hereto on APPENDIX E, or as otherwise agreed to. APPENDIX E contains additional information about
          OMNIA Partners and the cooperative purchasing program.

The solicitation also included a number of clauses required by FEMA (found in Appendix E, Exhibit F, starting on
Page 34 of the FEMA and Additional Federal Funding Special Conditions section of the RFCSP) that includes but is
not limited to: Conflicts of Interest, Public Policy, Affirmative Socioeconomic Steps, Federal requirements,
Contract Remedies, Termination for cause and Convenience, Equal Employment Opportunity, Davis-Bacon Act
and Copeland Anti-Kickback Act, Contract Work Hours and Safety Standards Act, Rights to Inventions Made Under
a Contract or Agreement, Clean Air Act and the Federal Water Pollution Control Act, Debarment and Suspension,
and Byrd Anti-Lobbying Amendment.

The proposals were evaluated by an evaluation committee. Using the evaluation criteria established in the RFP,
the committee elected to enter into negotiations with; ABM Industries Inc., Belfor USA Group Inc, Brown & Root
Industrial Services LLC, CORE Construction Service of Texas, F.H. Paschen, Preferred Facilities Group – USA,
Vaughn Construction, Weatherproofing Technologies Inc. and proceeding with contract award(s) upon
successful completion of negotiations.

Region 4 ESC, OMNIA Partners and the following offerors successfully negotiated a contract: ABM Industries Inc.,
Belfor USA Group Inc, Brown & Root Industrial Services LLC, CORE Construction Service of Texas, F.H. Paschen,
Preferred Facilities Group – USA, Vaughn Construction, Weatherproofing Technologies Inc. Region 4 ESC
executed the agreements, each with a contract effective date of March 1, 2025.

Diversity Certifications: Preferred Facilities Group – USA provided self-certification for Small Business Entity.

Contract Term: Initial two (2) -year agreement from March 1, 2025 through February 28, 2027 with the option
to renew for three (3) additional one-year periods through February 28, 2030.
