Request: It is requested that the Board of Education approve the District to contract with Canty Consulting Services for an amount not to exceed $84,000 from March 14, 2023 to September 30, 2023.
Why: This request is to approve the request to contract with Canty Consulting Services to provide administrative and compliance support to the DCSD for the implementation of the Davis Bacon Wage Rate requirements for approved construction projects funded with ESSER funds, to ensure that the district is in compliance with the Davis Bacon Wage Rate requirements.
Details: The U.S. Department of Education is requiring all local school districts that receive ESSER funds and use those funds for facilities improvements and upgrades to implement the U.S. Department of Labor’s Federal Labor Standards Act, commonly referred to as the Davis Bacon Wage Rate Requirements outlined in 29 Code of Federal Regulations, Part 5.5. As a business consultant with 14+ years of experience in the nonprofit sector and 6+ years in the affordable housing industry, Ms. Canty, CEO of Canty Consulting Services, has the specialized skill set, knowledge and technical abilities necessary to support the District’s Facilities/Maintenance Department to ensure compliance with the required Federal Regulations for construction projects.
Financial impact: The account charge code from which the expense will be paid is (100.2600.530000.00011.7520.9990.8013.040.0000) for a total amount not-to-exceed $84,000.00.

                        Meet Our Owner




Tammy Canty earned both a Master of Public Administration and a
Bachelor of Business Administration from Strayer University. Experience
in the nonprofit sector of over 14 years, and experience in the affordable
housing industry of over six years. She gained experience in the
affordable housing industry while working as the Director of Compliance
at a development and construction company.
In this role, she was responsible for monitoring the compliance of all
government construction projects. In 2021, Canty Consulting Services,
LLC was founded to provide compliance consulting services to
developers, public housing authorities, and general contractors.

                             WHO WE ARE
Canty Consulting Services, LLC is a small business located in Douglasville
Georgia focused on providing compliance services to government -
funded construction projects. Our firm helps Developers, Owners, and
General Contractors with their government regulations, including Davis-
Bacon, Section 3 and MBE/WBE requirements. We provide a wide range
of services for contractors of all sizes, including certified payroll training,
certified payroll preparation, and compliance training. In keeping with
our commitment to compliance, we ensure that all projects we
undertake meet local, state, and federal requirements.

                  Davis-Bacon Services

Contractor and subcontractor monitoring includes:
  • Assure that all bid documents, contracts, and subcontracts contain
    the Davis-Bacon wage decision and federal labor standard clause.
  • Assure no contracts is awarded to an ineligible contractor.
  • Provide Davis-bacon training and support to contractors so that
    they are aware of the requirement regarding wages and reporting.
  • Conduct on-site Davis-Bacon interviews with laborers and
    mechanics.
  • Ensure that certified payroll reports are submitted on a weekly
    basis.
  • Review certified payroll reports and related documents submitted
    by contractors.
  • Inspect certified payroll reports for discrepancies and/or
    underpayments.
  • Assure that all discrepancies have been corrected and revised
    certified payroll have been resubmitted.
  • Assure any back wage issues are resolved in a timely manner and
    revised certified payroll have been resubmitted.
  • Ensure the project wage decision and Davis-Bacon poster are
    posted at construction site.
  • Maintain a file system for labor standards.
  • Submit monthly discrepancies reports to contractor and owner.

                           Consulting Pricing
     • For Davis-Bacon consulting services on the Coralwood Education
       Center, Lithonia Middle School, International Student Center,
       Avondale Elementary, Mary McLeod Bethune Middle School, and
       Columbia Middle projects, the total contract price is $72,000. The
       price is for a six-month construction period beginning on March
       14, 2023, and concluding on September 30, 2023.
