The DeKalb County School District shall maintain a personnel file for each employee. The personnel file shall contain all documents required by law and all other items necessary for the administration of personnel employed by the District, excluding medical records relating to the American Disabilities Act, Family and Medical Leave Act of 1993, Omnibus Transportation Employee Testing Act of 1991, and Workers' Compensation. Personnel records of employees are legally defined as confidential.
Information or records in an employee’s personnel file may be subject to disclosure to the public under the Open Records Act. Personnel records not subject to public disclosure under the law may be released to third parties only upon written authorization of the employee. Personnel records shall be produced upon receipt of appropriate court orders or subpoena.
