Request: It is requested that the Board of Education establish a Phase I component Guaranteed Maximum Price of $87,044,255 for the construction of the New Middle and High School at Sequoyah SPLOST VI project per the terms set forth in the Construction Manager at Risk contract previously awarded to The Gilbane Building Company.
Why: To amend the agreement with The Gilbane Building Company for the construction of the New Middle and High School at Sequoyah project to establish its Component Guaranteed Maximum Price (GMP) #01 Early Release Package as $87,044,255.
Details: On June 12, 2023, the Board of Education approved the award of a Construction Management at Risk (CM@R) contract to Gilbane Construction Company for the completion of the New Middle and High School at Sequoyah Project and for Pre-Construction Services in the amount of $175,000.
Pursuant to that agreement the Design Professional (GMC), CM@R (Gilbane), Program Manager (ACERM), multiple DCSD Departments and DCSD Operations have collaborated to generate a design, a safe construction phasing plan and a Phase I CGMP in the best interest of the DeKalb County School District.
This action establishes a Phase I Component Guaranteed Maximum Price and Contract Time for all the Work set forth in the attached Gilbane CGMP Amendment 04-01-24
Financial impact: This project will be funded out of SPLOST VI Project 10136 - New Middle and High School at Sequoyah. If approved a budget of $87,044,255 will be created in the construction cost code (SP6NEWSCH.10136.GENERALCONTRACTOR) under the voter-approved E-SPLOST VI program.

CHRONOLOGY OF THE AGENDA ITEM
At its business mee ng on December 13, 2021, the DeKalb Board of Educa on approved the award of
RFP No. 22-752-011 to The Winter Construc on Company for design/build services for the renova ons
at the Green Forrest Drive facility for the lump sum amount of $4,906,500. The intent of the project was
to renovate the former Rockbridge Elementary School to serve as a swing space for other schools to
inhabit temporarily during construc on at the other school’s home facility. On March 23, 2022, a no ce
to proceed/commence was issued for the start of design and construc on with the substan al
comple on to achieved on or before October 14, 2022.
During the design phase, it was determined that the Green Forrest Drive loca on did not offer enough
opera onal and instruc on spaces to allow for the size of the schools with upcoming extensive
construc on projects to relocate to the Green Forrest Drive facility. Addi onally, plans were being
developed to allow portable classroom units to be located on the sites of the home schools with
upcoming extensive construc on projects. Based on these factors, DCSD reviewed various op ons for
the use of the facility and requested The Winter Construc on Company to prepare for alternate uses of
the facility.
In October of 2022, the determined use of the facility was s ll being reviewed and The Winter
Construc on Company was asked to con nue monitoring and protec ng the site through the remainder
of the year. In June of 2023, DCSD prepared a no ce of intent to terminate the contract for convenience.
On August 22, 2023, The Winter Construc on Company acknowledged the no ce and provided delivery
coordina on of purchased materials. Upon receipt of the materials, a deduc ve change order was
prepared resul ng in the execu on of Change Order No. 1 on November 12, 2023.
During the rou ng of signatures for Change Order No. 1, DCSD determined that the Green Forrest Drive
Facility could serve as a mul purpose opera onal facility. Because The Winter Construc on Company
was familiar with the site and project and the DCSD project manager had not yet received the executed
change order, both par es agreed to the rescindment of the contract termina on on November 3, 2023.
The approval of this Change Order No. 2 is for the rescindment of the contract termina on. The approval
of this Change Order No. 2 will provide needed repairs for a mul purpose opera onal facility at the
Green Forrest Drive Facility loca on.
