Request: It is requested that the Board of Education approve the District to contract with Canty Consulting Services for an amount not to exceed $250,000 from November 13, 2023 to November 12, 2024.
Why: This request is to approve the request to contract with Canty Consulting Services to provide administrative and compliance support to the DCSD for the implementation of the Davis Bacon Wage Rate requirements for approved construction projects funded with ESSER funds, to ensure that the district is in compliance with the Davis Bacon Wage Rate requirements. Canty Consulting Services is currently providing this service for previously approved construction projects funded with ESSER funds. Approval of this agreement would be a continuation of services for the remaining ESSER projects.
Details: The U.S. Department of Education is requiring all local school districts that receive ESSER funds and use those funds for facilities improvements and upgrades to implement the U.S. Department of Labor’s Federal Labor Standards Act, commonly referred to as the Davis Bacon Wage Rate Requirements outlined in 29 Code of Federal Regulations, Part 5.5. As a business consultant with 14+ years of experience in the nonprofit sector and 6+ years in the affordable housing industry, Ms. Canty, CEO of Canty Consulting Services, has the specialized skill set, knowledge and technical abilities necessary to support the District’s Facilities/Maintenance Department to ensure compliance with the required Federal Regulations for construction projects.
Financial impact: The account charge code from which the expense will be paid is (448.4000.530000.30521.7520.4190.8010.040.2022) for a total amount not-to-exceed $250,000.00.

Meet Our Owner
Tammy Canty earned both a Master of Public Administration and a Bachelor of
Business Administration from Strayer University. Experience in the nonprofit sector
of over 14 years, and experience in the affordable housing industry of over seven
years. She gained experience in the affordable housing industry while working as
the Director of Compliance at a development and construction company.
In this role, she was responsible for monitoring the compliance of all government
construction projects. In 2021, Canty Consulting Services, LLC was founded to
provide compliance consulting services to developers, public housing authorities,
and general contractors.

Davis-Bacon Services
Contractor and subcontractor monitoring includes:
• Ensure all bid, contract and subcontract documents contain the wage
determination and Davis-Bacon labor standards clauses (prime contractor
and sub-contractor)
• For prime contractors over $100, 000 comply with Contract Work Hours and
Safety Standards Act (CWHSSA)
• Provide Davis-bacon training and support to contractors so that they are
aware of the requirements regarding wages and reporting.
• Ensure no contracts are awarded to ineligible contractors.
• Ensure the Davis- Bacon poster and wage determination are posted at work
site.
• Collect certified payroll reports and statement weekly.
• Review certified payroll reports/related documents.
• Notify contractor and subcontractor of certified payroll deficiencies.
• Conduct confidential, onsite interviews.
• Review and submit additional work classification.
• Review use of apprentice and trainees.
• Report all alleged Davis-Bacon violations.
• Maintain full documentation of all certified payroll reports, certified payroll
related documents, interview forms, and restitution documents.

Consulting Pricing
Davis-Bacon consulting services for the CARES projects. For 21 projects, the price
covers a 12-month construction period beginning on October 1, 2023, and ending
on September 30, 2024.
A breakdown of the project's pricing and payment schedule can be found below.
The Contractor shall be paid in full for the last month worked on the project if the
project is completed before the 12-month period. During the term of this
agreement.

As a condition precedent to all required payments under this agreement and/or
Payment Schedule, the Independent Contractor shall submit to DCSD for review
and approval, invoices detailing the specific work performed for which payment is
requested, in a form acceptable to DCSD. Required payments under this
Agreement shall only be for actual work performed by the Independent Contractor
and shall only be pursuant to invoices reviewed and approved by DCSD.
